The reporting duty for each of these sections require you to provide your name and address. Only 26 USC ยง6041A(a) asks you to provide an identifying number ... but from whom is that number expected? There is no expectation for an identifying number from any other section. Be very suspicious anytime the written code becomes ambiguous, and this one is really ambiguous. Any person with respect to whom a return or statement is required under this section to be made by another person shall furnish to such other person his name, address, and identification number at such time and in such manner as the Secretary may prescribe by regulations. Hum . .. let's see if we can figure out what is being said here: any person [who is expected to provide] a return by another person shall furnish the other person his name . . . . . . shall furnish to such other person . . . in such manner as the Secretary . . . any person to whom a statement is required to be made by another person . . . . . . another person shall furnish to such other person . . . . . . a statement is required to be made by another person . . . any person [who is expecting] a statement [from] another person shall furnish [the] Okay. I give up. I think the only thing we can agree on here, is that this is truly ambiguous and totally meaningless. We can simply disregard this as any kind of requirement. After reviewing each piece of the code associated with the 31% withholding requirement, it becomes obvious that it applies only to a portion of interest paid and any other application is simply a myth. When someone threatens to withhold 3 1 % of the amount of money they owe you, be sure to remind them that you expect them to comply with the applicable laws and will seek criminal and civil damages if they violate the law or commit fraud against you. other person . . . any of the above
