Nothing in the preceding sentence shall be construed to require the disclosure of information which is subject to section 245A of the Immigration and Nationality Act (as in effect on the date of the enactment of this sentence). (e) Exemption The Secretary may by regulations exempt any class of individuals from the requirements of this section if he determines that applying this section to such individuals is not necessary to carry out the purposes of this section.
The law provides for a $500.00 penalty if you fail to answer this information correctly. However, according to United States General Accounting Office report GGD-98-106, NonfiIing Among US Citizens Abroad (May 1998), this is never enforced. On page 3, we read the following: . .. First, although IRS obtains passport data from the State Department, it has made little use of this data; and in recent years, IRS has not attempted to penalize the large number of applicants who fail to furnish an SSN, as the law provides. .. .
