(c) Requests for disclosure of social security number. Any component which requests an individual to disclose his or her social security account number shall inform that individual whether: (1 ) Disclosure is mandatory or voluntary. (2) By what statutory or other authority such number is solicited, and (3) What uses will be made of it. (See section 7 of the Privacy Act of 1974 set forth at 5 U.S.C. 552a, note.) This law clearly states that in the matter of money and finance that "An individual shall not be denied any right, benefit, or privilege provided by law by a componentbecause of such individual's refusal to disclose his social security number." A new area of law that the banks and financial institutions are attempting to enforce, is the requirement that the federal government has put upon the States to create laws that are beyond the legal limits of Congressional authority. That is, Congress is attempting to force the States to do that which they cannot legally do themselves. Of course, they neglect to recognize that if the federal Congress cannot do it, then the State cannot do it either. However, regardless of the Constitutional authority, or lack thereof, these new laws are causing additional difficulty for the unenumerated. 42 USC $666. Requirement of statutorily prescribed procedures to improve effectiveness of child support enforcement (a) Types of procedures required (17) Financial institution data matches. - (A) In general. - Procedures under which the State agency shall enter into agreements with financial institutions doing business in the State - (i) to develop and operate, in coordination with such financial institutions, a data match system, using automated data exchanges to the maximum extent feasible, in which each such financial institution is required to provide for each calendar quarter the name, record address, social security number or other taxpayer identification number, and other identifying information for each noncustodial parent who maintains an account at such institution and who owes past-due support, as identified by the State by name and social security number or other taxpayer identificationnumber; and (ii) in response to a notice of lien or levy, encumber or surrender, as the case may be, assets held by such institutionon behalf of any noncustodial parent who is subject to a child support lien pursuant to paragraph (4). However, this section only defines aprocedures under which the State agency shall enter into agreements with financial institutions. It contains no provisions for collecting or requiring identification numbers from customers.
