The Fifth Amendment of the Constitution of the United States protects you as well, stating: Amendment V No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation. The fifth amendment seems to apply only to criminal matters, but the Supreme Court ruled in McCarthy v. Arndstein, 266 US. 34, that the fifth amendment "applies alike to criminal and civil proceedings." Similar rulings have stated: "There can be no question that one who files a return under oath is a witness within the meaning of the Amendment. Sullivan v. United States 15 F. 2nd 809, and "The information revealed in the preparation and filing of an income tax return is, for Fifth Amendment analysis, the testimony of a "witness" as that term is used herein." Gamer v. United States, 424 us. 648.
