Purpose ... Sec. 6 Social security account numbers. (a) No agency shall deny, or permit any State or local government with whom it is involved in a cooperativeventure to deny, to any individual any right, benefit, or privilege provided by law because of such individual's refusal to disclose his or her social security account number. (b) Paragraph (a) of this section shall not apply with respect to: (1) Any disclosure required by Federal statute; or (2) Any disclosure to any agency relating to a system of records it maintained prior to January 1, 1975, if such disclosure was required under statute or regulation adopted prior to that date, to verify the identity of an individual. (c) Any agency in the Departmentwhich requests an individual to disclose his or her social security account number shall inform that individualwhether the disclosure is mandatory or voluntary, by what statutory or other authority the number is solicited, and what uses will be made of it. The agency shall also insure that this information is provided by a State or local government with whom it is involved in a cooperativeagreement. . . . ... (C) The social security number of the adult household member who signs the application, or an indication that helshe does not possess a social security number; ... ... eligibility for free or reduced price meals. These households shall be advised of the type or types of information andlor documents acceptable to the school. This information must include a social security number for each adult household member or an indicationthat such member does not have one. . .. ... The State agency shall require that a household participatingor applying for participationin the Food Stamp Program provide the State agency with the social security number (SSN) of each household member or apply for one before certification. ... ... (5) Taxpayer identification numbers. At the time of an initial request for authorization as well as reauthorization, an applicant firm must provide its employer identificationnumber and social security numbers as described below: ... [a)The regulations containedin this subpart are issued pursuant to the 4ct to prescribeproceduresfor the collection, use, and confidentialltyof Social Security Numbers (SSN) and Employer Identification Uumbers (EIN) and related records. The insurance provider is requiredto collect and recordthe SSN or EIN In each application or on any other form required by FCIC.

7 CFR 400.409 7 CFR 400.410 Penalties. ! 4nyone having access to the records identifying a participant's SSN or FIN will abide by the provisions of section 205(c)(2)(C) of the Social Security Act (42 U.S.C. 405(c)(2)(C), and section 6109(f), Internal 3evenue Code of 1986 (26 U.S.C. 6109(f) and the Privacy Act of 1974 '5 U.S.C. 552a). All records are confidential, and are not to be lisclosed to unauthorized personnel. Jnauthorized disclosure of SSN's or EIN's by any person may subject hat person, and the person soliciting the unauthorized disclosure, to :ivil or criminal sanctions imposed under various Federal statutes, ncluding 26 U.S.C. 7613, 5 U.S.C. 552a, and 42 U.S.C. 408.
