See ASSUMPSIT NON BIS IN IDEM [L. non + bis / twice, two ways + in + idem / the same thing] Not twice for the same thing. No man may be put in double jeopardy, i.e., tried twice for the same crime or act. NON CEPIT [L. non + capio, capere / to take, to seize] He did not take (it). The form of general-issue pleading in an action for replevin , by which the defendant denied that he had taken the plaintiff’s prop erty. The plea put in issue both the fact of taking and the place of taking.
